You Are not Allowed to Work with Q Visa in China

China issued upgraded identity cards for foreigners with permanent residence status on Friday (June 16), the new version of machine-readable ID cards, based on the design of the second generation identity card for Chinese citizens.

Qualifications and Documents of Applying for A Chinese Green Card

For foreigners who meet the following requirements are qualified for applying for a Chinese Green Card (permanent residence) in Guangdong
- Foreign applicants never had a record of breaking laws in China and stay in a good health condition;
- If the spouse of the applicant is a Chinese citizen, is required to have the legal residency in Guangzhou (the long-term residence shown on his/her Hukou should be Guangzhou; if she/he is a foreigner, has to acquire Chinese permanent residence;
- The marriage at least needs to exist for 5 years;
- The applicant consistently has lived in China for 5 years after marriage and every year at least stays in China for 9 months;
- The applicant has a stable income and residence for the living.
For point 5, According to the document, it describes in the terms of “a guarantee for a stable living”. We translate it as a stable income and residence here. As we mentioned at the very beginning, working is still needed in most of the situation, though applying for a green card by marriage.
Basic Documents
Fill the form “the Application Form for Permanent Residence Certificate in China for Aliens ” in Division of Exit & Entry Administration Department of Public Security, not available to download online now. (Two photocopies)
5 photos in blue background (no glasses, hats) and Receipt, see a sample below,
– Original and two photocopies of the valid passport of the applicant.
– Health certificate issued by the Guangdong Entry-Exit Inspection and Quarantine Bureau. (Two photocopies)
– Certificate of non-criminal record abroad authenticated by the Chinese
– Embassy or consulate stationed in the applicant’s country. (Two photocopies)
– Application letter for permanent residence. (Two photocopies)
Additional Documents
- For the applicant who has a Chinese spouse, is required to provide Hukou and Chinse ID card of his/her spouse;
- For the applicant who has a foreign spouse, is required to provide the permanent residence certificate of his/her spouse.
Both photocopy and original documents are needed for the following documents:
– The marriage certificate.
– Documents of bank deposit after notarization.
– Property certificate after notarization.
– Any necessary further documents asked by the police.
If documents above are issued by overseas organizations, all are necessary to be notarized by Chinese Embassy or consulate stationed in the applicant’s country. And translated by the Chinese notarization organizations.
After preparing for all these documents, go to Division of Exit & Entry Administration Department of Public Security. It costs approximately 180 days in applying for a Chinese permanent residence.
Reminder
Getting a Chinese green card by marriage, it does not mean you are legal to work in China!
WHY?
The documents of the applications by marriage and by working are different. Most people misunderstand a Chinese green card could replace a work permit. But the truth is, a work permit is a necessary document of applying for a Chinese green card by working. It means, if you get a Chinese green card by working, you already have a work permit! In this situation, many people misunderstand that a Chinese green card gives you the right to work in China legally!
So, if the green card you hold is acquired by marriage, you still need a work permit before starting working in China.
